1. Introduction

1.1.By submitting a registration, making payment, training in, or participating in any sports or recreational activities, events, or tournaments (collectively referred to as “Activities”) offered by Elevate Netball Club Pte Ltd:

(i) I confirm that I have read and understood this disclaimer; and

(ii) I agree to the terms outlined by Elevate Netball Club Pte Ltd, including its staff, contractors, and authorized organizers (collectively referred to as “ENC”, “we”, “us”, “our”).

2. Acknowledgment of Risks

2.1.I understand that I, my child, or my ward may be exposed to the inherent risks of injury and adverse weather conditions during participation.

2.2.I agree to ensure that I, my child, or my ward will adhere to all instructions and rules provided by ENC to minimize these risks.

2.3.I acknowledge that ENC will take reasonable precautions and exercise care to safeguard participants during Activities.

2.4.To the best of my knowledge, I declare that I, my child, or my ward have no medical conditions, injuries, or impairments that could increase the risk of participation.

2.4.1.I must notify ENC of any material changes to my or my child’s health or medical circumstances.

2.5.I confirm that neither I, my child, nor my ward is pregnant.

3. Personal Injury Insurance

3.1.By participating, I accept responsibility for ensuring that I and my family members have adequate personal injury insurance coverage. The organizers and associated parties are not liable for injuries, accidents, or medical expenses incurred during participation.

3.2.Participants are encouraged to review their insurance policies to ensure proper coverage. By engaging in Activities, I release ENC, its sponsors, and affiliated entities from liability for injuries, damages, or claims.

4. Indemnity

4.1.I accept that ENC is not responsible for any loss of property or injuries sustained during Activities, except in cases of personal injury or death caused by ENC’s negligence.

4.2.I waive any claims for loss or damage against ENC, except for personal injury or death resulting from their negligence.

5. Activities

5.1.Activities include those listed on ENC’s Instagram and Facebook, such as netball training, matches, tournaments, and holiday masterclasses organized by ENC or partner organizations.

5.2.Updates or changes to Activities will be communicated via the ENC Instagram and Facebook or through direct inquiries.

6. Payments, Refunds, and Cancellations

6.1. Term Fees

6.1.1.Term fees for netball must be paid in full before the start of the term. Late payments may incur additional administrative fees, and failure to pay could result in exclusion from Activities.

6.1.2.New members joining mid-term will be charged pro-rated fees, with full-term fees applying in subsequent terms.

6.1.3.Refunds or credits for missed sessions are only granted if:

6.1.3.1.A serious illness or injury, supported by a medical certificate, prevents participation for three or more consecutive weeks. A full refund for the remaining sessions will be provided.

6.1.3.2.A short-term illness or injury, supported by a medical certificate, in which case credits for up to 2 training sessions will be provided per term.

6.1.3.3.The club is informed at least 1 month in advance of an absence due to a pre-scheduled holiday or school event, in which case credits for up to 2 training sessions will be provided.

6.1.3.4.Notice is given prior to the first training session of the term, in which case a prorated fee will be provided and will not be entitled for 6.1.3.3.

6.1.3.5.Training cancellations due to unhealthy haze levels will result in a full credit for the canceled sessions.

6.1.3.6.ENC is not liable for disruptions caused by events beyond its control, such as natural disasters, pandemics, or other force majeure circumstances. In such cases, members will be informed of any planned actions via email.

6.1.4.Missed sessions do not ordinarily qualify for refunds or replacement sessions, except where expressly provided above or confirmed by ENC in writing.

6.1.5.Refunds are not provided for voluntary withdrawal during the term unless due to medical necessity as outlined above.

6.2. 4 Sessions Trial Package

6.2.1.The 4 sessions trial package is intended for eligible new players only, subject to the programme details published by ENC. Eligibility and any restrictions will be stated at registration.

6.2.2.This package covers 4 sessions and should be completed within the period communicated by ENC. Parents or guardians should contact ENC promptly if scheduling difficulties arise.

6.2.3.Refunds are not provided for voluntary withdrawal after starting the trial package unless due to medical necessity as outlined in 6.1.3.

6.2.4.Missed sessions are not automatically replaced, credited or refunded.

6.2.5.Any credit of trial fees towards future membership will apply only if expressly offered by ENC in writing.

6.3. Holiday Masterclasses / Programs

6.3.1.Registration is confirmed only upon full payment of the masterclass fees.

6.3.2.Fees are non-transferable unless approved by ENC.

6.3.3.Refunds are only provided if the masterclass is cancelled by ENC. No refunds or credits will be issued for voluntary withdrawal or non-attendance.

6.3.4.ENC reserves the right to cancel or reschedule a session due to unforeseen circumstances (e.g., coach illness, court unavailability, severe weather). In such cases, a replacement session or refund will be provided.

6.3.5.Masterclasses are open to participants within the specified age groups listed in the program details. Participants must follow all instructions and safety guidelines provided by ENC coaches.

6.3.6.ENC reserves the right to refuse participation to any individual who does not meet the skill, behavioral, or health requirements.

6.3.7.All other Terms & Conditions of Elevate Netball Club — including indemnity, personal injury insurance, personal data protection, and general participation rules — apply equally to Masterclasses.

7. Personal Data

7.1.Protecting your privacy is of utmost importance to ENC. The following clauses outline our practices concerning the collection, use, and sharing of your personal information when you participate in our Activities. “Personal information” refers to any information that identifies or can identify an individual, which we collect or are likely to have access to.

7.2.By engaging with our services, you agree to the practices described below.

8. Types of Personal Data

8.1.By interacting with ENC, submitting information, or registering for our activities, services, or promotions, you may be required to provide personal details.

8.2.Such details may include:

8.2.1.Your full name, contact details and email address;

8.2.2.Photographs or video recordings of you;

8.2.3.Payment information, such as credit/debit card or bank account details;

8.2.4.Your social media username(s).

8.3.Please ensure that all information you provide is accurate, complete, and up to date.

9. Purposes for Collection, Use and Disclosure of Your Personal Data

9.1.We collect, use, and disclose Personal Data to facilitate operations in compliance with financial and legal obligations.

9.2.This includes:

9.2.1.Managing business relationships with clients and fulfilling obligations in our agreements.

9.2.2.Facilitating payments for training, tournaments, memberships, and related services.

9.2.3.Sending communications about our programs, events, and promotions, as well as inviting participation in surveys or campaigns.

9.2.4.Administering membership applications, verifying personal details, processing transactions, and updating members on changes to policies or other administrative matters.

9.3.Personal Data may be shared with third parties like financial institutions or payment service providers to ensure secure transactions and support our operations or legal authorities if required by law, court order, or to protect our rights or the safety of others.

10. Personal Data Choices and Rights

10.1.Individuals have rights regarding their Personal Data under the Personal Data Protection Act (PDPA).

10.2.You may request to know whether ENC holds your Personal Data, view the information we retain, and understand how it is used or shared.

10.3.You may request updates or corrections to any inaccurate, incomplete, or outdated information.

10.4.You may also request ENC to restrict or delete your data in specific circumstances, in accordance with PDPA regulations.

10.5.Feedback or concerns related to Personal Data may be directed to ENC, and we will address them within a reasonable timeframe.

11. Policy Updates

11.1.ENC may revise its Terms & Conditions periodically to align with changes in our operations or comply with updated legal requirements.
